These Terms of Use ("Terms") govern your access to and use of the website at [insert your domain, e.g., appquesta.com] (the "Website"), operated by AppQuesta ("we," "us," or "our"). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, do not use the Website.

AppQuesta is an independent project and is not affiliated with, endorsed by, or sponsored by Google LLC, Google Play, or Android. Google Play and Android are trademarks of Google LLC.

0. Alpha / Early Access / Beta Status

As of the Effective Date of these Terms, AppQuesta is provided in an alpha / pre-release / early access / beta state. In this phase:

  • The service, features, user interface, data structures and rules are actively under development and subject to frequent and substantial changes.
  • User accounts, authentication records, search history, contributed data, rankings, virtual currency (coins), gas balances, market items, rewards, and all other user-associated data may be reset, deleted, rolled back, modified or made inaccessible — with or without prior notice.
  • No representation or warranty is made regarding the preservation, accuracy, completeness, security, continuity or future availability of any data or virtual assets.
  • Any virtual items (including but not limited to coins, gas and market items) acquired during this phase carry no expectation of persistence or future value.
  • We may, at our sole discretion and without liability, terminate, suspend, limit or reset any or all user accounts and associated data to support development, testing, bug fixes, schema changes or other needs.

Continued use of the Website during the alpha / beta phase constitutes your acknowledgment and acceptance of these risks.

1. Eligibility

You must be at least 13 years old (or 16 in jurisdictions where the age of consent is higher) to use the Website. By using the Website, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Website on behalf of an entity, you represent that you are authorized to bind that entity.

2. Account Registration

Registration is optional but may be required for certain features, such as saving search history, participating in rankings, or accessing personalized content. If you register, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized access.
  • Be responsible for all activities under your account.

We reserve the right to refuse or terminate registration at our discretion.

3. Use of the Website

The Website is provided for informational and discovery purposes, allowing users to search and explore publicly available data from the Google Play Store. It is not an app store, marketplace, or download service.

You agree to use the Website only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

  • Use the Website in any way that violates applicable laws or regulations.
  • Engage in abusive behavior, including spamming, harassing, or disrupting the service (e.g., excessive searches or attempts to overload servers).
  • Attempt to bypass metering, resource limits, or security measures.
  • Scrape, crawl, or extract data systematically without our prior written consent.
  • Reverse engineer, decompile, or disassemble any part of the Website.
  • Introduce viruses, malware, or harmful code.
  • Impersonate others or misrepresent your affiliation.
  • Use the Website for commercial purposes without our permission (e.g., reselling data).

We implement resource metering to prevent abuse and ensure availability. Game-like mechanics (including the virtual economy described in Section 5) are intended to enhance user experience and are subject to our sole discretion.

4. Content and Intellectual Property

Our Content: The Website, including its design, text, graphics, databases, search tools, and any publicly available data we organize (derived from Google Play), is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You may access and use this content for personal, non-commercial purposes only. No license is granted beyond this limited use.

User Contributions: If you submit content via the Contact form, Discord community, or other features (e.g., feedback, suggestions, or search contributions), you grant us a worldwide, royalty-free, perpetual license to use, modify, and distribute it in connection with the Website. You represent that you have the rights to grant this license.

We may remove or modify any content at our discretion.

5. Virtual Currency, Gas, Market and Rewards

The Website includes optional game-like features such as virtual currency called “coins” and “gas”, a “market” where users may purchase virtual items, and claimable “rewards”.

• Searches and the revealing of search results consume “gas”.

• Gas may be obtained by spending “coins” or through the claiming of rewards, .

• Market items and rewards (which may consist of coins, gas or virtual items) are provided solely for entertainment and discovery purposes.

All coins, gas, market items and rewards have no real-world monetary value and cannot be redeemed, sold, transferred, exchanged or converted into real currency, goods or services. They exist only within the Website and are subject to our sole discretion.

We may at any time, without notice and without liability:

• adjust, reset, suspend or delete any user’s coin or gas balance;

• modify, remove or change the price of any market item;

• alter, pause or discontinue the rewards system;

• revoke any previously claimed reward.

No refunds, exchanges or compensation will be provided for any coins, gas, market items or rewards, regardless of whether your account is terminated, suspended or you stop using the Website. You acknowledge that these features are offered “AS IS” and form part of the game-like mechanics described in Section 3.

Purchases made with coins in the market are final and non-refundable.

6. Third-Party Services and Links

The Website may include links to third-party sites or services (e.g., Discord, YouTube embeds, Google Play app pages). We are not responsible for their content, privacy practices, or availability. Your interactions with them are at your own risk.

We use third-party services like Google Analytics and Cloudflare, as described in our Privacy Policy.

7. Disclaimers

The Website is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including accuracy, completeness, reliability, or fitness for a particular purpose. We do not warrant that the Website will be uninterrupted, error-free, or secure.

Data on the Website is derived from publicly available sources and may contain errors or become outdated. We make no representations about app quality, security, or suitability.

8. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website, even if advised of the possibility. Our total liability shall not exceed $100.

This limitation applies regardless of legal theory (contract, tort, etc.).

9. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, losses, or damages arising from your violation of these Terms, misuse of the Website, or infringement of third-party rights.

10. Termination

We may suspend or terminate your access to the Website at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Website ends immediately.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted here with an updated effective date. Continued use of the Website after changes constitutes acceptance.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located within AppQuesta's State and County of choice. You waive any objections to venue or jurisdiction.

13. Miscellaneous

These Terms constitute the entire agreement between you and us. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce any right does not waive it.
